petition, with liberty to assail the correctness of the interlocutory orders,

under Order XLIII Rule 1A of the Code of Civil Procedure, 1908, if he

is required to file the first appeal against the judgment and decree, which

may be passed by the trial court.

Learned counsel representing respondent no.1 has no

objection thereto.

Ordered accordingly.

All the pending miscellaneous applications, if any, are also

disposed of.
