The appellant has come up in appeal against the order dated

15.11.2021 whereby petition filed by the husband under Section 13 of

the Hindu Marriage Act, 1955 for dissolution of marriage by a decree of

divorce has been dismissed.

Both the parties are present in Court today.

They have mutually agreed to take a divorce under Section

13-B of Hindu Marriage Act, subject to the condition that appellant will

keep paying 20,000/- per month to the respondent-wife and daughter till

the daughter settles down in her life i.e. her education and marriage.

Statements of both the parties be recorded to this effect.

Both are educated persons.

The appellant-Lt. Col. Anirudh Singh and respondent-

Sheetu Kaul are present in Court today and statement of both parties has

been recorded separately. As per the statement of the appellant, he

undertakes that he will pay Rs.20,000/- per month by transferring the

same in the bank account of Sheetu Kaul for her as well as for minor

daughter Kanishka. He undertakes to look after all needs of his

daughter Kanishka till she settles down in life. Statement of

respondent-Sheetu Kaul has also been recorded to the effect that She is

ready to accept Rs.20,000/- per month till the minor daughter settles

down in her life.

Both the parties have mutually agreed to withdraw all the

cases which they have filed against each other.

Keeping in view the compromise effected and the

statements made by both the parties, who are physically present to

attend the Court proceedings today, this Court while exercising its

jurisdictional power is converting the instant appeal into the petition

under Section 13-B of the Hindu Marriage Act, 1955. The judgment and

decree dated 15.11.2021 passed by the Additional District Judge,

Chandigarh, is set aside. The instant petition is allowed and the

marriage between the parties is hereby dissolved by way of mutual

consent. Decree-sheet be drawn accordingly.

Pending application (if any) stands disposed of.
