AT CHANDIGARH
Civil Revision No.5908 of 2022
Date of Decision:-21.12.2022
Sunita
...Petitioner
Versus
Satpal and others
...Respondents
CORAM:- HON'BLE MS. JUSTICE NIDHI GUPTA
Present:- Mr. Chetan Kapoor, Advocate for the petitioner.
NIDHI GUPTA J.(Oral)
This Civil Revision is filed against the order dated 11.11.2022
passed by the Civil Judge (Sr. Divn.) Ganaur in Execution Petition No.35 of
2019, titled as 'Sunita vs. Satpal and others' whereby the learned Civil Judge
(Sr. Divn.), Ganaur has dismissed the execution petition of the petitioner.
It is admitted by the learned counsel for the petitioner that the
Execution Petition was filed in the Civil Suit No.432 of 2014 of the
judgment and decree dated 26.10.2018 passed therein. Learned trial Court
in the impugned order has noticed that Manga-Judgment Debtor No.2 and
Kusum-Judgment Debtor No.3 arrayed in the present Execution Petition
were not parties in the said Civil Suit No.432 of 2014 and therefore
judgment dated 26.10.2018 is not applicable to them.
Learned counsel for the petitioner accepts this to be a correct
1 of 2
position.
Therefore, I find no ground is made out to interfere in the order
dated 11.11.2022 passed by the learned Civil Judge (Sr. Divn.) Ganaur,
hence, the present Civil Revision is hereby dismissed.
Pending application(s), if any, stand disposed of.
