STATE OF PUNJAB AND OTHERS ... Respondents

CORAM: HON'BLE MR. JUSTICE MAHABIR SINGH SINDHU

Present: Mr. Neeraj Sharma, Advocate
            for the petitioners.

            Ms. Lavanya Paul, DAG, Punjab.

MAHABIR SINGH SINDHU, J.

Present writ petition has been filed under Article 226/227 of the

Constitution, inter alia, for directing the respondents to correctly refix the

pay of petitioners consequent upon the judgment passed by this Court in

CWP-10759-1990 decided on 30.05.2008 (P-1).

Learned counsel, on instructions from the petitioner, submits

that instead of pressing the writ petition on merits at this stage, his clients

would be satisfied in case, legal notice dated 17.09.2022 (P-13) is decided

expeditiously.

Notice of motion to that limited extent.

On the asking of the Court, Ms. Lavanya Paul, DAG, Punjab,

accepts notice on behalf of respondent(s)-State. Learned State counsel raises

no objection against the innocuous prayer made on behalf of the petitioners.

In view of the agreed stand taken by both sides, but without

adjudicating the controversy on merits, writ petition is disposed off with

direction to respondent No.1-Principal Secretary, Department of Water

Supply and Sanitation, Punjab, to decide the aforesaid legal notice by

1 of 2

passing a reasoned order in accordance with law within a period of 03

(three) months from the date of receipt of certified copy of this order.

Needless to say that in case there is a failure on the part of

competent authority, petitioner(s) would be at liberty to move appropriate

application(s) for revival of this writ petition.
