Present: Mr.Vishal Sharma, Advocate

H.S.MADAAN, J. (ORAL)

This is a second petition for grant of pre-arrest bail filed

by petitioner/accused Harminder Singh @ Ramu. His first petition bearing

CRM-M-34108-2020 was dismissed as withdrawn vide order dated 28.10.2020.

The order for ready reference is being reproduced as under:

"Case taken up through video conferencing.

After arguing for sufficient time, realizing that the Court

was not inclined to grant the relief, learned counsel for the petitioner states that

he be permitted to withdraw the present petition.

Permission is granted.

Dismissed as withdrawn."

Now the petitioner has again approached this Court for

grant of pre-arrest bail. This petition is not maintainable. The Apex Court in a

recent judgment G.R. Ananda Babu Versus The State of Tamil Nadu & Anr.

Decided on 28.1.2021 has observed that successive anticipatory bail applications

ought not be entertained and more so when the case diary and the status report

clearly indicated that the accused is absconding and not co-operating with the

investigation.

This petition is nothing but misuse of process of law.

However, learned counsel for the petitioner has expressed

regrets and sought permission to withdraw the present petition.

Dismissed as withdrawn.
