For the Petitioner/s : Mr.Sanjay Kumar Pandey No.5, Advocate For the Respondent/s : Mr. Anil Kumar Singh, GP 26 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJAN GUPTA ORAL JUDGMENT Date : 20-12-2021

Heard learned counsel for the parties.

The operative part of the order reads as under:

"19. ....Apex court in case of Ratan Singh vs Union of India 1997(11) SCC 396 held that in view of the long time gap from the date of termination to date of reinstatement the apex court granted the relief for compensation in place of back wages with reinstatement. This case was relating to daily wages worker.

20. From above discussion, pleading of both parties, oral and documentary evidence of the parties and submission of the both parties and nature of case keeping in view of entire material. The court instead of reinstatement with back wages Patna High Court CWJC No.11629 of 2021 dt.20-12-2021

consolidated sum of Rs. 1,00,000/- (One Lakh) is given as a compensation to meet the end of justice.

21. I pass my award accordingly."

Today, workman is present in person pursuant to order

passed on the last date of hearing. He admits that an amount of Rs.

1,00,000/- has already been paid to him. I find no infirmity with

the order passed by the Labour Court. Learned counsel for the

petitioner has confined his argument only for enhancement of

compensation amount.

On due consideration, I find no ground for the same to

take up this plea.

The petition is thus without any merit and is hereby

dismissed.
