01. 1. Heard learned counsel for the respective parties.

2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Bentkar P.S. Case No.96 of 2022 corresponding to G.R. Case No.1324 of 2022 pending in the file of learned J.M.F.C.-4, Cuttack on the grounds stated therein.

3. Perused the FIR as at Annexure-1. Learned counsel for the petitioners submits that petitioner No.1 was in relationship with the informant for about two years and during that time, they spent money for each other. Referring to Annexure-2, a copy of the bank statement, it is further submitted that petitioner No.1 transferred money to the account of the informant during that time. Gone through the contents of the FIR i.e. Annexure-1 and the allegations made therein. Considering the fact that the parties were in relationship for some time and thereafter separated, recording the submissions of the learned counsel for the respective parties, this Court

though not inclined to grant pre-arrest bail to petitioner No.1 but is of the view that petitioner Nos.2 & 3 should be allowed to go on bail in the event of arrest with suitable conditions. This Court is also of the view that in view of the nature of dispute, petitioner No.1 should be directed to surrender before the learned court below for being released on bail with suitable conditions imposed.

4. Accordingly, it is ordered.

5. In the result, ABLAPL is disposed of. It is further directed that in the event, petitioner No.1 surrenders within a fortnight from today before the learned J.M.F.C.-4, Cuttack in connection with Bentkar P.S. Case No.96 of 2022 corresponding to G.R. Case No.1324 of 2022, she shall be released on bail subject to her furnishing a bail bond of Rs.20,000/- (Rupees twenty thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. In so far as petitioner Nos.2 & 3 are concerned, they shall be released on bail by the Arresting Officer in the event of arrest on furnishing a bail bond of Rs.20,000/- (Rupees twenty thousand) each with one solvent surety for the like amount each with a condition that they shall cooperate the IO in the investigation as and when necessary.

6. Issue urgent certified copy as per rules.
