03. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel for the State-Opposite Parties. Perused the writ application as well as the documents annexed thereto.

3. The Petitioner has filed the present writ application with the following prayer:

"It is, therefore, humbly prayed that this Hon'ble Court be graciously pleased to:

i) Admit the writ application.

ii) Call for the records.

iii) Issue a writ in the nature of mandamus or any other writ/writs, direction/directions directing the opposite parties, more particularly opposite party No. 1 and 2 to extend the benefit of placement in the Lecturer (Group-

A) Scale of pay as well as Reader (State Scale) scale of pay in favour of the petitioner retrospectively w.e.f.

01.06.2002 and 01.06.2012 by suitably modifying the Govt. Notification dated 13.06.2017 and Notification dated 18.05.2020 respectively in respect of the petitioner, issued under Annexure-2 Series, in terms of Rule-4 and 9 of the Odisha Non-Government aided college Lecturer's Placement Rules, 2014, keeping in view law decided by this Hon'ble court in the case of Chittaranjan Das Vrs. State of Odisha & Ors. (W.P. (C) No. 8976 of 2017 disposed of on 03.04.2023), so also a similar judgment was passed in the case of Dolamani Meher and batch Vrs. State of Odisha & Ors. (W.P.(C) No.4312 of 2016 and batch disposed of on 06.07.2023), and further to extend the similar benefits as has been extended in favour of Chittaranjan Das vide Govt. Notification dt. 16.03.2024 and further the petitioner may be extended with all other consequential service and financial benefits as due and admissible, including the differential arrears within a reasonable time by the Hon'ble court.

iv) And/or pass such other order/orders. direction/ directions as this Hon'ble Court may deem fit and proper for the ends of justice."

In course of hearing of the writ application, learned counsel for the Petitioner submits that the Petitioner ventilating his grievance has submitted representation before the Commissioner- cum-Secretary, Higher Education Department, Govt. of Odisha, Bhubaneswar, Opposite Party No.1 under Annexure-4. It is also submitted by the learned counsel for the Petitioner that the said representation is pending as of now. It is also submitted by the learned counsel for the Petitioner that a direction be issued to the Opposite Party No.1 to consider the representation of the Petitioner under Annexure-4 within a stipulated period of time.

5. Learned Additional Standing Counsel submits that she has

no objection if the representation of the Petitioner is considered by the Opposite Party No.1, which is stated to be pending, in accordance with law within a stipulated period of time.

Considering the limited nature of grievance of the Petitioner, the writ application is disposed of at the stage of admission with a direction to the Opposite Party No.1 to consider the representation of the Petitioner under Annexure-4 taking into consideration the judgment at Annexure-3 series to the writ application, i.e., in the case of Chittaranjan Das v. State of Odisha & Ors. in W.P.(C) No.8976 of 2017 decided on 03.04.2023 and in the case of Dolamani Meher v. State of Odisha & Ors. in W.P.(C) No.4312 of 2016 decided on 06.07.2023 & a batch of similar other writ applications within a period of eight weeks from the date of production of certified copy of this order. The Opposite Party No.1 shall do well to dispose of the representation of the Petitioner under Annexure-4 by passing a speaking and reasoned order. The decision so taken by the Opposite Party No.1 be also communicated to the Petitioner within ten days thereafter.

7. With the aforesaid observation/ direction, the writ application stands disposed of.

8. Issue urgent certified copy of this order as per Rules.
