03. 1. Mr. Sahoo, learned counsel appears for Opposite Party No.4.

The power filed by him is kept on record.

2. Heard Mr. Ray, learned counsel for the Petitioner, Mr. Behera, learned counsel for Opposite Parties 2 & 3, Mr. Tripathy, learned AGA for the State and Mr. Sahoo, learned counsel for Opposite Party No.4.

3. The prayer of the Petitioner is regarding detention of his vehicle bearing registration No.OD-02-X-9915 (Tata Goods Carrier) by the police for non-payment of the arrear tax and challan amount.

4. Mr. Behera, learned counsel for Opposite Parties 2 & 3 as well as Mr. Tripathy, learned AGA for Opposite Party No.1 submits upon instruction that no such seizure memo has been prepared in respect of detention of the vehicle.

5. Accordingly, the authorities i.e. Opposite Party No.2 is directed to release the vehicle in favour of the Petitioner in the event the Petitioner deposits Rs.15,000/-, i.e. 50% of the Challan amounts, within a period of 15 days from today and subject to production of all documents of the vehicle including insurance certificate and true copy of application for fitness.

6. Further, the writ petition is disposed of granting liberty to the Petitioner to approach the competent authority against the Challan amounts issued in respect of the vehicle.

7. Urgent certified copy of this order be granted on proper application.
