01. 1. Heard Mr. B. Satapathy, learned counsel for the Petitioner and Mr. G. Tripathy, learned Additional Government Advocate for State-Opposite Parties.
2. It is submitted on behalf of the Petitioner that the Tahasildar is proceeding against him for eviction without granting any opportunity of hearing.
3. Accordingly, the writ petition is disposed of at the stage of admission with a direction to the Tahasildar, Derabishi, Dist.- Kendrapara (Opposite Party No.4) to grant due opportunity of hearing to the Petitioner and take a decision, in accordance with law, within a period of six weeks from the date of receipt of certified copy of this order along with a copy of the writ petition. Till such decision is taken by Opposite Party No.4, the Petitioner may not be evicted from the case land.
4. An urgent certified copy of this order be granted on proper application.
