02. 1. This matter is taken up through hybrid arrangement.

2. This CONTC has been filed due to violation of the

judgment / order dated 09.01.2023 passed in W.P.(C)

No.12301 of 2021 and W.P.(C) No.15912 of 2022.

3. Heard.

4. At the outset, learned counsel for the Petitioner submits

that though the judgment/ order dated 09.01.2023 passed

in the above noted Writ Petitions was implemented by the

authority concerned by the orders dated 06.02.2023 &

07.02.2023 vide Annexures-2 & 3 which was never

challenged by any of the affected parties, on 04.12.2025 the

Digitally Signed order already implemented has been recalled by the

restoring the seniority in favour of the persons who had

lost the case in W.P.(C) No.15912 of 2022.

5. In such view of the matter, this Court directs Smt. Niyati

Pattnaik, IAS, Director of Higher Secondary Education,

Odisha/ Contemnor No.1 to appear before this Court

through Virtual Mode on the next date i.e. on 3rd February,

2026 at 2.00 P.M. to explain as to why she will not be

punished under the Contempt of Court's Act.

6. List this matter on 3rd February, 2026 at 2.00 P.M.
