2. This appeal has been filed challenging the judgment dated 15.12.2025 passed by the learned Special Judge (Vigilance), Keonjhar in VGR No. 03 of 2012/T.R. No. 11 of 2014 convicting the appellants for commission of offences punishable under Section 13(1)(c)(d) read with Section 13(2) of the P.C. Act and Section 409/468/471/34 of the IPC read with Section 120-B of the IPC and sentencing them there under. The appellants have been sentenced to undergo RI for 2 years and to pay fine of Rs.5,000/- each and in default of payment of fine to undergo RI for another month for the offence punishable U/s.l3(2) of the P.C. Act. 1988 and to undergo rigorous imprisonment for 3 years and to pay fine of Rs.10,000/- each and in default of payment of fine to undergo RI for another 2 months for the offence U/s.409/34 I.P.C., to undergo rigorous imprisonment for 1 year and to pay fine of Rs.5,000/- each and in default of payment of fine to undergo RI for another 1 month on

each count for the offences U/s.468/120-B/34 I.P.C. and to undergo rigorous imprisonment for 1 (one) year for the offence U/s.471/34 I.P.C. There is a direction for the sentences to run concurrently.

4. Call for the scanned copy of the Trial Court Records.

5. List this case on 08.04.2026.

6. Mr. Sanjay Kumar Das, learned Standing Counsel (Vigilance) submits that he shall file appearance memo by 04.02.2026.

7. This is an application under Section 415(2) of BNSS for grant of bail to the Appellants during pendency of the appeal.

8. Learned counsel for the appellants-petitioners submits that the petitioners were on bail during trial and have not mis-utilised his liberty.

9. Considering the sentence imposed and as the appellants were on bail during trial, I am inclined to allow the I.A.

10. The Appellants- Sripada Naik and Sadananda Naik on surrendering before the learned trial Court within four weeks from today before the learned trial Court, shall be released on bail pending disposal of the Criminal Appeal, on such terms and conditions as may be fixed by the Court.

11. This I.A. is disposed of.

12. This I.A. has been filed for staying realization of fine amount.

13. The appellants-petitioners shall deposit the fine amount in the

learned trial Court within a period of four weeks from today. Such deposit shall be subject to result of the appeal.

14. This I.A. is disposed of.

15. Urgent certified copy of this order be granted on proper application.
