                                       ORDER
Order No. 21.01.2026
   02.

W.A. No.1879 of 2025 & I.A. No.4611 of 2025

This Writ Appeal calls in question a learned Single Judge's judgment dated 31.07.2024, whereby Appellant's W.P.(C) No.17035 of 2016 laying a challenge to the disciplinary matter is negatived.

2. Appeal is filed after brooking a delay of 82 days, as reported by the Registry. An application supported by affidavit seeking its condonation accompanies the appeal memo. Delay is short and no objections are filed to the application in question. That apart, throwing away the writ petition only on the ground of delay would not auger well to the justice of the case, as rightly argued by the learned counsel appearing for the Appellant. In view of that, the application is allowed and delay stands condoned.

3. Various submissions vociferously submitted before us have been meticulously considered in W.A. No.2720 of 2024 vide judgment dated 31.07.2024, which runs into 18 plus pages.

Therefore, what has already been decided on the points now urged, cannot be subject matter of one more adjudication because of doctrine of res judicata.

In the above circumstances, this appeal being devoid of merits is liable to be dismissed and accordingly it is, costs having been made easy.

Web copy of this order to be acted upon by all concerned.
