1. This matter is taken up through hybrid

arrangement.

2. This I.A. has been filed by the Petitioner for

extension of the interim bail passed by this Court vide

order dated 30.01.2026 in I.A. No.86 of 2026.

3. Learned counsel for the Petitioner submits that the

Petitioner was earlier granted interim bail vide order dated

30.01.2026 passed by this Court, which is going to be

expired on 20.02.2026. The Petitioner is suffering from an

emergency situation due to the birth of a premature baby

and certain medical complicacy has been arisen. The said

hospital to save the child. The newborn child was kept in

Neonatal Intensive Care Unit (in short "NICU") for a

period of 12 days, under constant medical supervision and

critical care. After discharging from the NICU, the child is

required continuous specialized medical treatment. From

14.02.2026 to 16.02.2026, the treating doctor continued

post-NICU treatment and monitoring. But, on 16.02.2026,

considering the fragile condition of the premature

newborn, the child was referred to a higher Pediatric

Super-Specialist Hospital, i.e. Sardar Vallabhbhai Patel

Post Graduate Institute of Pediatrics, Cuttack, for

advanced and urgent treatment of severe pneumonia.

Hence, the Petitioner prays for extension of the interim bail

granted earlier for a further period of four weeks time from

today.

4. Learned Additional Standing Counsel for the State

as well as the learned counsel for the Informant strongly

objected to the prayer for extension of interim bail on the

ground that the Petitioner has four criminal antecedents to

his credit i.e.

i.Bhadrak Town Police Station (Bhadrak

District) case No.264 dt.25.09.2016 U/s

381/406/408/420 IPC. The case has been

charge sheeted.

case No.372 dt.29.06.2024 U/s

3(5)/318(4)/336(2)/340(2) of BNS. The case

is pending investigation.

iii.Bhadrak Town Police Station (Bhadrak

District) case No.567 dt.21.09.2025 U/s 5 of

Orissa Fire Works and Louder Speaker

(Regulation) Act, 1958/221/292/296/3(5) of

BNS/182/of MV Act. The case has been

charge sheeted.

iv.Baisinga Police station (Mayurbhanj

District) case No.103 dt.28.05.2019 U/s

408/420 IPC. Charge sheeted showing

accused Ramanarayan Bal as 'Absconder'.

Hence, learned counsel for the State submits that

the Petitioner does not deserve any sympathy from the

Court.

5. Upon hearing the learned counsel for the petitioner

and on going through the averments made in this I.A, and

the grounds taken in the application, this Court is swayed

by the sympathy factum to the cause of the present

Petitioner and not deciding the matter on merit. It is purely

an interim arrangement for the wellbeing of the newborn

baby who is suffering from pneumonia and admitted in

Digitally Signed hospital.

6. Accordingly, the period of interim bail granted in

terms of the order dated 30.01.2026 passed by this Court in

I.A. No.86 of 2026 is hereby extended for a further period

of four weeks with effect from today for attending the

newborn baby. This prayer of the Petitioner is granted

purely on humanitarian ground.

7. Further, the Petitioner is directed to appear before

the I.I.C., Lalbag Police Station on every alternative day

between 9.00 a.m. to 10 a.m. during the period of interim

bail. The Petitioner is also directed to surrender before the

Court in seisin over the case after expiry of the period of

interim bail without fail.

8. The I.A stands disposed of, accordingly.
