ORDER
Order No. 10.04.2026
6. 1. This matter is taken up through hybrid mode.
2. Mr. Nayak, learned Additional Government Advocate submits that against the order of dismissal of SLP(C) Diary No.24746 of 2024, the State of Odisha has filed a review petition, which has been registered as Diary No.1724 of 2026.
3. Mr. Mishra, learned Senior Advocate appearing for the Petitioner submits that the State Government is not taking any step either to remove the defect in the said review petition or to get it listed. In that process, the Petitioner is seriously prejudiced, as he is deprived of getting the benefit of the order dated 14th September, 2023 passed in W.P.(C) No.24288 of 2023. The order dated 14th September, 2023 in W.P.(C) No.24288 of 2023 was passed holding that the Petitioner shall be extended the benefits, as granted to the Petitioner in W.P.(C) No.6871 of 2012.

3.1. Against the judgment in W.P.(C) No.6871 of 2012, the State Government has preferred SLP(C) No.24746 of 2024, which has already been dismissed vide order dated 25 th February, 2025. In the garb of filing review petition, the State Government is not implementing the order. He, therefore, prays for proceeding with the contempt application.
4. Mr. Nayak, learned Additional Government Advocate submits that the review petition was last listed before the Hon'ble Supreme Court on 17th March, 2026. But, he has no instruction with regard to further development, if any, in the said review petition. He, however, prays for a short adjournment to get complete instruction.
5. Thus, taking a lenient view in the matter, this CONTC is adjourned to be listed on 8th May, 2026, on which date, Mr. Nayak, learned Additional Government Advocate shall apprise the Court about the developments, if any, in the said review petition.
