03. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. This is an application U/S.483 of BNSS by the petitioner for grant of bail in connection with Delanga P.S. Case No.335 of 2025 corresponding to TR Case No. 105 of 2025 (GR Case No. 121 of 2025) pending in the file of learned Addl. District Judge-cum-Special Court under POCSO Act, Puri for commission of offences punishable U/Ss.65(2) of BNS r/w. Sec. 6 of POCSO Act, on the main allegation of committing rape and aggravated penetrative sexual assault upon the victim aged about 12 years.

3. Heard, Mr. Sanjit Mishra, learned counsel for the petitioner and Mr. S.C.Pradhan, learned Addl. PP in the matter and perused the record. None appears for the victim despite being duly informed as apprised by learned Addl. PP.

4. After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis

the accusations sought to be brought against him and regard being had to the materials placed on record including the statement of the victim and taking into account the other circumstance on record in entirety and keeping in view the presumption as available U/S. 29 of POCSO Act, this Court is not inclined to grant bail to the petitioner.

5. Hence the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately transmitted to the Court in seisin over the matter for reference.
