01. (Through hybrid mode)

1. Mr. Bikram Narayan Daschoudhury, learned counsel

appearing on virtual mode submits that the Petitioner has taken away

the file from the counsel and Mr. Alok Kumar Mohapatra, learned

counsel and his associates have no instruction to proceed with the

case.

2. A memo to that effect, signed by the learned counsel, who

holds power on behalf of the Petitioner, is required to be filed.

3. This CRLMP has been filed for a direction to the Opposite

Parties to register a case and take necessary action.

4. It has been stated in the CRLMP that a complaint had been

submitted to the Purighat Police Station on 09.01.2026. As no case

was registered on the same day, a representation was sent to the

Deputy Commissioner of Police as well as the Secretary, Home

Department on 09.01.2026. She claims that complaint was handed

over to the IIC, Purighat Police Station and on the very same day,

representation had been sent to the Deputy Commissioner of Police,

Cuttack as well as the Secretary, Home Department.

5. It is apparent that the Petitioner has not followed the

procedure laid down in the BNS.

6. Be that as it may, since the learned counsel submits that the

Petitioner has taken away the file in the interest of justice, list this

case on 09.04.2026.

7. Registry to ascertain if any other counsel has appeared on

behalf of the Petitioner and indicate his/her name in the cause list.
