  02.        1.     The appellant-husband is before this Court challenging the

common judgment passed by the learned Judge, Family Court, Bhubaneswar in C.P. No.289 of 2022, filed by the respondent-wife as well as in C.P. No.593 of 2024 filed by the appellant-husband in the marriage.

2. By the respondent-wife, petition was filed under Section- 27 of the Special Marriage Act and the appellant-husband filed

Civil Proceeding, seeking relief of dissolution of marriage under Section-13(1)(i-a) of the Hindu Marriage Act. Both the C.Ps. have been decided together by grant of decree of divorce dissolving the marriage solemnized between the appellant-husband and the respondent-wife at Indore, Madhya Pradesh on 23rd December, 2015.

3. It is submitted by the learned Senior Counsel that the maintenance granted is exorbitant and is not qualified reasons given by the learned Court. On being asked by the Court to secure the decree for us to interfere, it is fairly submitted by the learned Senior Advocate that the appellant will make a deposit of Rs.30,00,000/- (Rupees thirty lakh) only before this Court within six weeks and the appellant may be granted permission to deposit the amount in installments.

4. Issue notice along with this order, subject to the appellant depositing Rs.30,00,000/- within six weeks in installments. The installment that would be deposited before this Court shall be in favour of the Registrar Judicial. The amount deposited shall be invested in a high interest yielding short term deposit in any Nationalized Bank with auto renewal clause to the credit of the appeal.

Requisites for issuance of notice to the respondent by Speed/ Registered Post with AD be filed within five working days. Early returnable date be fixed.

5. List after SR. Liberty to mention.

I.A. No.447 of 2025 & I.A. No.458 of 2025

6. Subject to deposit of Rs.30,00,000/- (Rupees thirty lakh) only in installments as directed above within six weeks, the operation of the judgment and decree impugned to the extent of the

direction to pay permanent alimony of Rs.1,50,00,000/- shall remain stayed.

Regarding compliance of the direction regarding deposit of Rs.30,00,000/- in installment, it is submitted by the learned Senior Advocate that within three weeks the first instalment shall be deposited.

7. List for orders on 27th October, 2025 for reporting compliance of the order regarding deposit of the first instalment.
