Non-compliance of order/direction contained in judgment dated 4th December, 2023 passed in WPC(OAC) No.2424 of 2016 is brought to notice by way of this contempt petition.

Learned counsel appearing for the petitioner submitted that since the judgment dated 4th December, 2023 has not been complied with within the period stipulated therein, the contempt petition bearing CONTC No.3738 of 2024 was filed, which came to be disposed of vide order dated 9th May, 2024 by extending it by granting further period of one month to comply with the said judgment dated 4 th December, 2023. Paragraph-4 of the said order reveals as follows:-

"4. Considering the facts and circumstances of the case and upon hearing learned counsel for the Parties, this Contempt Petition is disposed of by granting one month further time to the Opp. Parties- Contemnors to comply with the order passed on 04.12.2023. However, if the order is not complied with within the extended time, it will be held as deliberate violation of this Court's order."

2.1. It is submitted that vide letter No.1479, dated 31st May, 2024 issued by the Principal, S.C.S.(A), College, Puri to the Joint Secretary to Government, Department of Higher Education, Odisha, Bhubaneswar, reads as under:-

"In inviting a reference to the subject cited above, I am sending herewith the CONTC No.3738 of 2024 and the order passed by Hon'ble Mr. Justice Biraja Prasanna Satapathy on 09.05.2024 received by this Office for your kind consideration and necessary action."

2.2. He further submitted that even though this Court vide order dated 9th May, 2024 in CONTC No.3738 of 2024 granted further one month time to comply with the judgment dated 4th December, 2023 on the concession of the learned Additional Standing Counsel appearing for the State-opposite parties, yet the authority concerned has not taken any step to comply with the order/direction.

3. Issue notice to the opposite parties-contemnors by Speed Post with A.D., requisites for which shall be filed within three working days. In the event of furnishing such requisites within the period stipulated, the Office shall send the notice to the said opposite parties by fixing a short returnable date.

4. List this matter on 17th October, 2025.
