01. Petitioner has structured his prayer as under:

"Under the aforesaid facts and circumstances of the case, it is therefore, prayed that this Hon'ble Court may graciously be pleased to issue a writ in the nature of mandamus or any other appropriate writ, direction/ Order and thereby allow the I.A., C.P.Ed. scale of pay with Grade Pay at Rs.2800/-, as has been given to other similarly persons/employees, as stated supra and thereby further direct the Opp. Parties to clear up the arrear differential salary and Grade Pay of the petitioner from the date of his regularization, in terms of O.R.S.P. Rules,2017 within a stipulated period, as may be prescribed by this Hon'ble Court for the interest of justice"

Essentially, the grievance is as to what should be the Grade Pay.

Learned counsel for the petitioner submits that the Grade Pay has to be Rs.2800/- whereas what has given to his client is Rs.2200/-, and that this is contrary to certain decisions of Coordinate Bench of this Court. One such decision is in W.P.(C) No.13112 of 2021 between Rajib Kumar Sahoo v. State of Odisha and others disposed off on 19.02.2024. He also draws attention of this Court that in respect of similarly circumstanced employees, the benefit of this judgment has been extended, and that step-motherly attitude is shown for the petitioner.

3. Learned AGA appearing for the O.Ps. submits that he would instruct O.P. No.2 to look into the grievance of the petitioner, as has been reflected in O.P. No.4's letter dated 24.08.2023 at Annexure-8 addressed to O.P. No.2.

In the above circumstances, petition is disposed off. Time for compliance is eight weeks. O.P. No.2 is to inform the result of consideration to the petitioner in writing within the said period.

It is open to the answering OP No.2 to solicit any information or documents from the side of the Petitioner, as required for taking a decision on the subject representation. However, in that guise delay shall not be brooked.

Now, no costs.
