03. I.A. No.2423 of 2025

1. This matter is taken up through Hybrid mode.

2. This interlocutory application has been filed for release of the Appellant on interim bail.

3. Heard leaned counsel for the Appellant as well as learned counsel for the State.

4. Learned counsel for the Appellant at the outset contended that the Appellant on being convicted for the offences vide judgment dated 30.10.2024 is in jail custody. On perusal of the judgment, it appears that he has been convicted for alleged commission of offence punishable under Section 10 of the POCSO Act and he has been sentenced to undergo RI for five years. Learned counsel for the Appellant at this juncture contended that in the meantime the father of the Appellant has died on 31.08.2025.

5. Learned counsel for the State, on instruction from the Inspector-In-Charge of Chandanpur P.S. vide letter dated 04.09.2025, submitted before this Court that the aforesaid information is correct and that the father of the Appellant, namely one Laxmidhar Behera has died on 31.08.2025.

6. In view of the aforesaid position, this Court is inclined to release the Appellant on interim bail for a period of four weeks to participate in the last rites of his father subject to such terms and conditions as it deemed just and proper by the trial Court. However, it is further made clear that on expiry of the interim bail period, the Appellant shall surrender immediately before the Court below and submit the surrender certificate before this Court by the next date.

7. Accordingly, this I.A. stands disposed of.

8. Issue urgent certified copy of this order as per Rules in course of the day.

9. List this matter in the week commencing 13th October, 2025.
