Learned counsel appearing for the petitioners submitted that though the petitioners are regularized in terms of the judgment dated 5th March, 2020 passed in WP(C) No.31679 of 2011 (Dhananjay Charan Dey and others Vs. State of Orissa and others, 2020 (II) ILR- CUT84), which was confirmed by the Division Bench of this Court in Writ Appeal and, subsequently, the Special Leave Petition preferred by the State against the writ appeal was also dismissed, the opposite parties have not extended similar benefit as is granted to Sikshya Sahayak. The opposite parties have notionally fixed their pay with effect from the date of regularisation till 5th March, 2020, i.e., the date of judgment passed in the case of Dhananjay Charan Dey (supra).

1.1. Being aggrieved, the petitioners have approached this Court by way of filing this writ petition with a prayer to extend the actual pecuniary benefit.

1.2. He further submitted that in case of similarly circumstanced persons, this Court in the case of Dharitri Sahoo and another Vs. State of Odisha and others (WP(C) No.30827 of 2024) directed the opposite parties to file counter affidavit.

2. Ms. Aishwarya Dash, learned Additional Standing Counsel appeared and waived issue of notice on behalf of opposite parties.

3. List this matter along with WP(C) No.30827 of 2024 on the date fixed therein.
