Bench: B.P. Routray, Chittaranjan Dash
IN THE HIGH COURT OF ORISSA AT CUTTACK
                            MATA No. 143 of 2019

              Baijayanti Rani Singh .... Appellant
                                       Mr. S.K. Mishra, Sr. Advocate
                                      -versus-
              Anilla Kumar Singh .... Respondent
                                          Mr. P.C. Mishra, Advocate

                         CORAM:
THE HON'BLE MR. JUSTICE B.P. ROUTRAY
THE HON'BLE MR. JUSTICE CHITTARANJAN DASH
                            ORDER
Order No. 17.03.2025

 19. 1. Heard learned counsel for the Parties.

2. Present Appeal is directed against the impugned judgment dated 29th October 2019 passed in C.P. No. 114 of 2015 of the learned Judge, Family Court, Khurda, wherein the decree of divorce by dissolution of marriage has been declared without granting any permanent alimony.

3. Admittedly, the husband-Respondent has remarried to one Sarmila Swain as reflected in our previous order. The husband is a retired military personnel getting pension and also having landed properties and other business income, according to the wife.

4. The challenge in present Appeal is only limited to the quantum of permanent alimony.

5. Upon hearing both parties and considering the age of both parties including the fact that two minor children are staying with the wife-Appellant now, and their place of residence as well as status, in our opinion, an amount of Rs.10,00,000/- towards permanent alimony would serve the purpose. The Appeal is accordingly disposed of with a direction to the husband- Respondent to pay the permanent alimony of Rs.10,00,000/- within a period of two months from today by depositing the amount before the learned Judge, Family Court, Khurda. It goes without saying that the decree of divorce is left undisturbed. The affidavit filed on behalf of the wife today is kept on record.

                                                                      (B.P. Routray)
                                                                          Judge
