04.     1.        Heard Mr. Rao, learned Senior Advocate for the petitioner.


2. Instant petition is filed challenging the impugned judgment under Annexures-3 and 5 and direct dismissal of the suit in C.S. No.54 of 2019 instituted by the opposite party on the grounds stated.

3. Learned counsel for the opposite party is present and it is submitted that a copy of the petition with annexures has not been served on them. Accordingly, learned counsel for the petitioner is directed to serve it in course of the day.

4. Upon receiving a copy of the petition with annexures, the opposite party is to file a response before the next date serving a copy of the same on the other side well in advance.

5. List on 11th April, 2025.

Awaiting response from the opposite party and considering the submission of Mr. Rao, learned Senior Advocate for the petitioner, this Court, as an interim measure, in view of the delivery of possession in respect of the suit property which is likely to take place, as is apprehended, directs that the proceeding in Execution Petition No.10 of 2024 pending before the court of learned Senior Civil Judge, Rayagada and its disposal shall be deferred till the next date.

5. Urgent certified copy of this order be issued as per rules.
