01. 1. Heard Mr. Mohanty, learned counsel for the petitioner.

2. Instant revision is filed challenging the impugned judgment dated 6th December, 2024 in Criminal Appeal No.31 of 2024 of learned 1st Additional Sessions Judge, Berhampur, Ganjam confirming the decision of learned JMFC, Digapahandi Ganjam in G.R. Case No. 223 of 2007.

3. The petitioner has been convicted for offences under Section(s) 457 & 380 IPC and sentenced to undergo imprisonment separately.

4. Recorded the submission of Mr. Mohanty, learned counsel for the petitioner and gone through the grounds stated.

5. Considering the plea advanced by the petitioner while challenging the impugned judgment in Criminal Appeal No. 31 of 2024, the Court is inclined to have the response of the State. Hence, it is ordered. Issue notice. Mr. Ray, learned AGA accepts notice for the State. An extra copy of the petition with annexures is directed to be served on the State.

6. List on 17th July, 2025 for final hearing and orders.

3. The facts pleaded on record are reiterated by Mr. Mohanty, learned counsel for the petitioner while seeking release of the petitioner on bail. Considering the submissions, this Court, as an interim measure, directs release of the petitioner on bail in connection with G.R. Case No. 223 of 2007 subject to suitable conditions imposed by learned JMFC, Digapahandi, Ganjam.

4. List on the date fixed for further orders.

5. Issue urgent certified copy of this order as per rules.
