01. 1. Heard Mr. Pradhan, learned counsel for the petitioner.

2. Instant writ petition is filed by the petitioner challenging the impugned judgment dated 20th February, 2025 of learned District Judge, Ganjam, Berhampur in Election Appeal No.01 of 2024 vide Annexure-4 confirming the decision of learned Civil Judge (Junior Division), Kabisuryanagar dated 10th May, 2024 in Election Case No.03 of 2022 as at Annexure-3 on the grounds stated.

3. It is submitted by Mr. Pradhan, learned counsel for the petitioner that there has been delay in filing the election petition by opposite party No.4 and such delay was condoned despite specific objection was raised from the side of the petitioner. It is submitted that the judgment in Election Case No.03 of 2022 stands confirmed in appeal by order of the learned District Judge, Ganjam, Berhampur. Considering the facts pleaded on record and submission as above, the Court is inclined to issue notice to the opposite parties.

4. Hence, it is ordered.

6. Mr. Sahoo, learned ASC for the State accepts notice for and on behalf of opposite party Nos.1 to 3. Notice to opposite party No.4 by Registered Post with AD making it returnable at an early date and for the said purpose, requisites shall be filed by Mr. Pradhan, learned counsel for the petitioner within seven days from today.

7. List on 23rd July, 2025 for final hearing and orders.
