1. This matter is taken up through hybrid mode.
2. Heard learned counsel for the Petitioner and learned counsel appearing for the Opp. Parties.
3. Petitioner has filed the present writ petition inter alia with the following prayer:-
"Under the above circumstances it is therefore humbly prayed that this Hon'ble Court may graciously be pleased to:-
i. Admit this writ application;
ii. Call for the records/documents from the opp. parties;
iii. Quash Sl. No. 282 of the office order No. 15955 dated 27.04.2017 issued by Director of Higher Education placing the petitioner as Lecturer (Grade-A) with effect from 01.08.2007 under Annexure-5;
iv. Quash Sl. No. 89 of the Notification No. 19994/HE dated 10.05.2023 issued by Special Secretary, Department of Higher Education placing the petitioner as Reader (SS) with effect from 01.08.2017 under Annexure- 6;
v. Quash Sl. No.63 of the Notification No. 44885/HE. dated 08.11.2024 issued by opp. party No.1- Commissioner-Cum-Secretary Department of Higher Education placing the petitioner as Lecturer (Group-A) in Odia with effect from 17.12.2009 only under Annexure-9;
vi. Direct the opp. parties, particularly opp. party No. 1- Principal Secretary, Department of Higher Education, to grant the petitioner the benefit of Lecturer Group- A scale of pay w.e.f. 01.06.2006 and the Reader (SS) scale of pay w.e.f. 01.06.2016 in terms of the judgment dated 03.04.2023 passed by this Hon'ble Court in WP(C) No.8976 of 2017 titled as Chittaranjan Das Vs. State of Odisha & Others;
vii. Issue further direction(s)/order(s) directing the opp. parties, particularly opp. party No.1 and 2, to calculate the differential arrears and pay same to the petitioner within a stipulated period;
viii. Pass such other order/ orders as this Hon'ble Court may deem it fit and proper to give complete relief to the petitioner;
And for this act of kindness, the petitioner shall, as in duty bound, ever pray."
4. However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a fresh representation before Opp. Party No. 1 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of two (2) weeks hence.
4.1. It is observed that if such representation is moved within the aforesaid time period, Opp. Party No. 1 shall do well to take a lawful decision on the same within a period of three (3) months from the date of receipt of such representation. The order so passed by Opp. Party No. 1 be communicated to the Petitioner.
4.2. It is further observed that along with the representation, order passed in the case of Chittaranjan Das Vs. State of Odisha & Others so relied on by the learned counsel for the Petitioner be enclosed.
5. With the aforesaid observation and direction, the Writ Petition is disposed of.
