06. 1. Heard Ms. S. Sahoo, learned counsel for Appellant and Mr. R. Pradhan, learned Additional Public Prosecutor for State- Respondent.

2. The Appellant, namely, Sarathi Kisan, who has been convicted by learned Addl. Sessions Judge-cum-Special Court (under POCSO Act), Sambalpur in the judgment dated 31.03.2023 in S.T. No.149/136/102 of 2015-2017-2020 for commission of offence under Section 376-D, I.P.C. read with Section 6 of the POCSO Act and sentenced to undergo R.I. for 30 years along with fine, has prayed to release him on bail pending appeal.

It is submitted on behalf of the Appellant that, other two convicts, namely, Pratap Patel and Rajendra Kumar Nayak@Raje Khadi, who are standing on similar footing with the present Appellant, have already released on bail by this Court in CRLA Nos.561 & 725 of 2023. It is further submitted that the present

Upon hearing both parties and taking note of the period of custody undergone by the present Appellant till date and that other convicts, who are standing on similar footing with the present Appellant, have been released on bail, it is directed to release present Appellant on bail pending appeal in connection with aforesaid case on such terms and conditions as the learned Addl. Sessions Judge-cum-Special Court (under POCSO Act), Sambalpur may deem just and proper.

5. The I.A. is disposed of.

6. List this appeal along with CRLA Nos.561 & 725 of 2023 in the 1st week of December 2025 for hearing.
