2. Heard Mr. S.P. Mohanty, learned counsel for the appellant. Perused the impugned judgments.

4. Considering the submissions and the grounds raised, the second appeal is admitted on the following substantial questions of law:-

i. Whether non-payment of consideration by itself can be a ground to nullify the sale deed?

ii. Whether both the courts below were correct in holding that in such a situation title had not passed to the vendee?

5. Issue notice to the respondent by registered post with A.D. making it returnable within four weeks. Requisites be filed within three working days.

6. Call for the LCR.

7. List this matter in the month of December, 2025.
