02. 1. Heard Mr. Tripathy, learned counsel for the appellant and Mr. P.K. Mishra & Mr. Sinha, learned counsels for the respondents.

2. The present appeal is directed against the judgment dated 31.07.2022 passed by the learned Commissioner for Employees Compensation-cum- Divisional Labour Commissioner, Berhampur in E.C. Case No.26 of 2019. By the impugned judgment, Rs.12,84,136/ has been awarded in favour of the

respondents, which includes the interest component as well.

3. The parties have entered into a settlement. They have agreed to settle the dispute. The matter is heard at length.

4. The Court is of the considered view that the compensation amount may be reduced to a consolidated amount of Rs.10,50,000/- (Rupees ten lakhs fifty thousand). Learned counsels for the respondents have agreed to the said reduced amount as full and final amount.

5. The entire awarded amount has already been deposited before the Divisional Labour Commissioner, Berhampur, Ganjam. Rs.10,50,000/- (Rupees ten lakhs fifty thousand) shall be disbursed to the respondents along with the interest accrued thereon and the remaining amount shall be refunded to the appellant along with the interest accrued thereon.

6. It is needless to say that the appellant-Insurance Company has right to recover the amount from respondent No.5 in accordance with law, if it's recoverable.

7. In terms of the above, the FAO is disposed of.
