04. 1. Learned counsel for the Petitioner submits that in spite of direction of this Court dated 01.08.2020 in W.P.(C) No.19388 of 2022, in which this Court referred to the judgment passed in similar matter i.e. Pramod Kumar Patra & others v. State of Odisha & others, which was affirmed by order dated 19.01.2024 in Intra Court Appeal W.A No.1677 of 2023, the authorities are denying the Petitioner his legitimate claim to be brought over to the work charge establishment.
2. In such view six weeks time be granted to the learned counsel for the State to file counter affidavit.
3. List this matter on 02.04.2025.
4. The Petitioner is at liberty to file his response within one week of receipt of such counter.
5. If by the date fixed, there is no counter affidavit filed, it is made clear that the matter shall be heard and disposed of materials on record.
6. As prayed for, a copy of this order be made over to the learned counsel for the State to enable him to take follow up action.
