11. 1. Heard learned counsel for the parties.
2. Both parties admitted at the outset that they have no grievance with regard to decree of divorce and the challenge is limited only to the quantum of permanent alimony.
3. The Appellant-husband has prayed to reduce the quantum, whereas the wife-Respondent through her cross-appeal has prayed to enhance the same.
4. The fact that both the wife and husband are employed in software sector at Bangalore, is undisputed. As per the affidavit furnished by both of them, the husband is getting around Rs.22 lakh per annum and the wife was getting Rs.5 lakhs per annum prior to 5 years. Thus, taking note of the status of both the parties particularly their financial status and the nature of employment, we are not inclined to disturb the quantum as fixed by the learned Judge, Family Court, Baripada who has directed for payment of Rs.10 lakhs as permanent alimony. Thus, the same is confirmed.
The appeal as well as cross-appeal is disposed of. It goes without saying that the amount directed in the impugned judgment shall be paid within a period of four weeks from today.
