01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. Heard learned counsel for the Appellant.

3. Appeal is admitted.

4. Call for the digitized copy of the T.C.R.

5. List this matter immediately after receipt of the T.C.R.

6. Heard.

7. This I.A application has been filed for stay of realisation of fine amount.

8. Considering the submissions, it is directed that the realization

of fine amount shall remain stayed awarded in Special G.R Case No.527 of 2013 (Computer Registration No.19 of 2014) by the learned Additional District & Sessions Judge (FTSC), Jajpur till disposal of the appeal.

9. Accordingly, the I.A stands disposed of.

10. This I.A. application has been filed for release of the appellant-petitioner on bail/ suspension of sentence.

11. Heard learned counsel for the appellant-petitioner as well as learned counsel for the State. Perused the records.

12. It is stated by learned counsel for the appellant-petitioner that the appellant has been convicted under Section 365 of IPC and sentenced to undergo R.I for 3 years and to pay a fine of Rs.3000/- (Rupees Three Thousand). He further submitted that the appellant has already served the sentence to the extent of 5 months and that after delivery of the judgment the appellant has been released on interim bail by the learned trial court.

13. Taking into consideration the severity of the punishment and the sentence already undergone, this Court is inclined to release the appellant on bail.

14. Further, it is directed that the appellant-Petitioner be released on bail in Special G.R Case No.527 of 2013 (Computer Registration No.19 of 2014) by the learned Additional District & Sessions Judge (FTSC), Jajpur on such terms and condition as deemed just and proper by the learned trial court.

15. With the aforesaid observations/ directions, the I.A stands disposed of.
