                                      ORDER

12.12.2025 Order No.

01. 1. Heard Ms. Jena, learned counsel for the petitioner and Mr. Ray, learned AGA for the State.

2. Instant revision is filed by the petitioner assailing the impugned judgment in Criminal Appeal Case No.04 of 2025 at Annexure-2 on the grounds stated.

3. The petitioner stands convicted for an offence under Section 323 IPC, whereas, acquitted for the other offences by the court of 1st instance and finally confirmed in appeal vide Annexure-2.

4. Ms. Jena, learned counsel for the petitioner submits that considering the self-same evidence, the petitioner has been acquitted for other offences, whereas, convicted under Section 323 IPC hence, therefore, the impugned judgment i.e. Annexure-2 confirming the order of conviction and sentence cannot be sustained in law.

5. Considering the submission of Ms. Jena, learned counsel for the petitioner, the Court is inclined to direct the State to respond.

6. Hence, it is ordered.

7. Notice.

8. Mr. Ray, learned AGA for the State accepts notice for the opposite party.

9. An extra copy of the revision petition with the annexures is requested to be served on the State by tomorrow.

10. List on 22nd January, 2026 for final orders.

02. 1. Heard.

2. Instant I.A. is filed by the petitioner for release of the petitioner on bail.

3. Considering the fact that the petitioner has been convicted only for an offence under Section 323 IPC and directed to undergo a sentence of six months only, this Court pending disposal of the revision, is inclined to allow him to go on bail with conditions.

4. Accordingly, it is ordered.

5. Consequently, the petitioner is directed to be released on bail in connection with C.T. (S) No.64 of 2022 subject to conditions imposed by the learned Civil Judge, Senior Division (LR&LTV)-cum-ASJ, Angul.

6. List on the date fixed for orders.

7. Urgent copy of this order be issued as per the rules and in course of the day.
