                                        ORDER

11.12.2025 Order No. I.A. No.3234 of 2025

02. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. This I.A. has been filed by the learned counsel for the Petitioner seeking modification of the order dated 17.10.2025. As such, the order dated 17.10.2025 is hereby recalled.

3. Accordingly, the I.A. is disposed of.

4. Heard learned counsel for the Parties.

5. This is an application under Section 482 of the Cr.P.C. read with Section 528 of BNSS has been filed by the Petitioner with a prayer to consider the bail application in connection with Boipariguda P.S. Case No. 79 of 2009 corresponding to C.T. Case No.35 of 2021 pending in the court of learned Addl. Sessions Judge -cum- Special Judge,

Jeypore.

6. Taking into consideration the submissions made by learned counsel for the Petitioner, further taking into consideration the fact that the Petitioner is in custody, this Court grants liberty to the Petitioner to move a fresh application for regular bail before the learned trial court within three weeks from today. In such eventuality, the learned trial court shall consider and dispose of the bail application of the Petitioner strictly in accordance with law, as expeditiously as possible. While considering the bail application of the Petitioner, learned court below shall keep in view the judgment in Hussainara Khatoon & Ors. & Ors. Vs. State of Bihar reported in (1980) 1 SCC 81.

7. On an application being filed by the Petitioner along with a copy of today's order, the Case Diary be made available before the trial court for consideration at the time of hearing the bail application of the Petitioner.

8. Accordingly, the CRLMC stands disposed of.

Issue urgent certified copy of this order as per Rules.
