   03.       I.A. No.270 of 2025

1. This is an application for condonation of delay of 198 days as pointed out by the Stamp Reporter in preferring the instant writ appeal against the impugned judgment dated 26.04.2024 passed by the Single Bench in W.P.(C) No.36109 of 2021.

2. Heard learned counsel for the parties.

3. Learned Senior Advocate appearing for the respondents drew attention of this Court to the objection affidavit, submitted that the writ appeal has been filed on 07.01.2025 with delay of 220 days, which is after it came to their knowledge that CONTC No.6954 of 2024 was filed on 12.09.2024 and the appellants had not explained sufficient cause of delay in Interlocutory Application. Therefore, the same is liable to be dismissed.

4. After perusal of the averments made in paragraphs-2, 3, 4 and 5 of the instant application, we are satisfied that there is no deliberate laches in preferring the appeal, but for serious

consideration with respect to implementation of direction of the learned Single Judge with respect to policy decision, which took considerable length of time to file the appeal. The appellant being prevented by sufficient cause for not filing the instant appeal within the statutory period of limitation provided therefor, the delay of 198 days occurred. This Court feels it apposite to condone the delay in the circumstances.

5. In view of the above, the delay is condoned and, accordingly, I.A. stands disposed of.

6. List this matter on 4th September, 2025 under the heading "Fresh Admission".
