01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. Heard learned counsel for the parties and perused the records.

3. This is an application under Section 482 of the Cr.P.C. read with Section 528 of B.N.S.S. has been filed by the Petitioner with a prayer to consider the bail application in connection with Boriguma P.S. Case No.122 of 2021 corresponding to T.R. No.72 of 2021 pending in the court of learned District & Sessions Judge, Koraput-Jeypore.

4. Learned counsel for the Petitioner during course of argument submits that the Petitioner does not want to press this application with liberty to the Petitioner to raise all the points at the time of framing of charge by filing a discharge petition.

5. Considering the submission made, this CRLMC stands disposed of as not pressed.

6. Learned counsel for the Petitioner further contended that the Petitioner has been custody since 23.08.2021. In such view of the matter, liberty is granted to the Petitioner to move a fresh bail application before the learned trial court. In the event any such bail application is filed, this Court observes that the same shall be considered keeping in view the judgments in Rabi Prakash vs. State of Odisha (SLP (Crl) No.4169 of 2023 dtd.13.07.2023, case of Ankur Choudhury vs. State of Madhya Pradesh (SLP (Crl) No.4648 of 2024 dtd. 02.01.2024 and Mohd. Muslim @ Hussain Vs. State (NCT of Delhi) in Special Leave Petition (Crl) No.915 of 2023 dtd. 28.02.2023 and disposed of by passing a reasoned order.

7. Accordingly, the CRLMC is disposed of.

Issue urgent certified copy of this order as per Rules.
