MATA no.416 of 2023 and I.A. no.432 of 2023 Order No.

1. 1. Mr. Dash, learned advocate appears on behalf of appellant and

submits, his client was second wife of Birendra Kuanr, since deceased.

Accordingly, she filed the civil proceeding for declaration. By

impugned judgment dated 20th January, 2023, inter alia, the civil

proceeding was dismissed. His client being aggrieved has preferred the

appeal on delay, reported at 208 days. Application has been made for

condonation.

2. Issue notice along with this order on the application and appeal.

Accept one set of process fee for service by registered/speed post with

AD. Applicant will put in requisites.
