01. This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

This is an application for condonation of delay. The Stamp Reporter has pointed out that there is a delay of eighteen days in preferring the appeal.

Learned counsel for the State seeks to file objection to this interim application.

Since one of the offence is under section 376-AB of the Indian Penal Code, let an extra copy of the appeal memo, the impugned judgment along with its annexrues be served on the learned counsel for the State by tomorrow (26.09.2023), who shall send the same to the Inspector in-charge of Odagaon police station for its service on the informant in (Odagaon P.S. Case No.204 of 2018) intimating him that the matter will be taken up // 2 //

in the week commencing from 9th October 2023 and if he so likes, he can engage a counsel to oppose the prayer for bail. A written proof regarding service of notice be obtained from the informant.

List this matter in the week commencing from 9th October 2023.

Learned counsel for the appellant has filed the xerox copies of the deposition of the witnesses examined in the learned trial Court, which are taken on record.

Case diary and instruction relating to criminal antecedents, if any, against the appellant shall be obtained in the meantime as well as regarding sufficiency of service of notice on the informant.

Objection, if any, be filed in the meantime giving copy thereof to the learned counsel for the appellant.

A free copy of the order be handed over to the learned counsel for the appellant.
