16.10.2023 Order No. This matter is taken up through hybrid mode. 01 2. In course of hearing, this Court made a query as to whether the writ appeal is maintainable against the order passed by the learned Single Judge, when he has scrutinized the order passed by the Collector under Section 26 of the Odisha Gram Panchayat Act or not.
3. Mr. S.K. Dalai, learned counsel appearing for the appellants contended that the learned Single Judge has exercised power under Article 226 of the Constitution of India, while scrutinizing the order passed by the Collector under Section 26 of the OGP Act. Therefore, he seeks time to satisfy this Court by citing some judgments to that effect. However, in case of any urgency, it is open to the appellants to move before the Vacation Court.
