04. 1. Heard Mr. Prasenjeet Mohapatra, learned counsel appearing for the Petitioner and Mr. S.K. Mishra, learned Senior Counsel along with Miss Prajna Sarita Mohanty, learned counsel appearing for Opposite Party No.2.

2. It is stated that the claim of the petitioner is covered by the judgment of this Court in Mukesh Kumar Agrawal v. State of Odisha and Others : W.P.(C) No.18325 of 2023 disposed of on 21st June, 2023. It has also been admitted by Opposite Party Nos.2 and 4 in their counter affidavit at para-12, which reads as follows:

"12. It is humbly submitted that, the petitioner alleges that, the Tender Committee qualified the technical bid of Opp.Party No.5 who had not uploaded the Income Tax Return for the Assessment Year 2022-23 through online.

On scrutiny of the uploaded Tender documents of Opp.No.5 by the DLTC, it is found that he had uploaded the IT Return for AY. 2020-21 and 2021- 22 except 2022-23 through online and submitted an undertaking to provide all the required documents with the Tender papers."

3. In that view of the matter, the present writ petition stands disposed of in terms of the judgment of this Court rendered in Mukesh Kumar Agrawal (supra).

4. An urgent certified copy of this order be issued as per rules.
