09.10.2023 Order No. This matter is taken up through hybrid mode.

2. Heard learned counsel for the parties.

3. Mr. Sujan Kumar Roy Choudhury, learned counsel for the Petitioner states that the case of the Petitioner is covered by the judgment of the apex Court in the case of State of Odisha & Others v. Radheshyam Agrawal, 2023 SCC OnLine SC 331, wherein the very same clause was under consideration. Therefore, this matter may be disposed of in the light of the aforesaid judgment, to which Mr. H.M. Dhal, learned Additional Government Advocate appearing for the State-Opposite parties has raised no objection.

4. In view of the above submission, the impugned order/letter under Annexure-2 series is hereby quashed. The writ petition stands disposed of in terms of the judgment passed by the Apex Court in the case of Radheshyam Agrawal (supra). The Opposite Parties are directed to work out the direction contained in the aforesaid judgment of the apex Court.
