03. 1. The present Appellants were the Interveners in W.P.C (OA) No.887 of 2019, which has been dismissed by the learned Single Judge by the impugned judgment dated 22nd December, 2022.

2. Mr. Jayant Kumar Rath, learned Senior Counsel appearing for the Appellants informs the Court that the original Writ Petitioner Prasanth @ Prasanta Kumar Hanuman had also filed W.A. No.11 of 2023 in this Court challenging the impugned judgment, but since he got his promotion in the meanwhile, he withdrew the said writ appeal, which was then dismissed as withdrawn by this Court on 2nd February, 2023.

3. Mr. Rath, learned Senior Counsel submits that the present Appellants had sought intervention to be heard along with the Writ Petitioners since their rights would be adversely affected, if the gradation list which was challenged, was to be confirmed.

4. Issue notice. Mr. Manoj Kumar Khuntia, learned Additional Government Advocate accepts notice on behalf of Respondent

Nos.1 to 4. Since he accepts notice, let required number of copies of the writ appeal be served on him within three working days.

5. Issue notice to Respondent No.5 by Speed Post/Registered Post with A.D., making it returnable before the next date. Requisites be filed within three working days. The tracking report be placed on record before the next date.

6. List on 17th August, 2023.
