                 5.         1.      This matter is taken up through Hybrid mode.

2. None appears for the Petitioner at the time of call.

3. Judgment dated 17th October, 2014 passed by learned Judge, Family Court, Dhenkanal in Criminal Proceeding No.275 of 2013 is under challenge in this RPFAM, whereby the Petitioner has been directed to pay maintenance of Rs.2,000/- per month to the Opposite Party No.1/Wife and Rs.1,000/- per month to the Opposite Party No.2/the minor daughter with effect from the date of application, i.e., 2nd December, 2013.

4. As it appears, there is delay of 32 days in filing the RPFAM. Since none appears to pursue the limitation petition in Misc. Case No.42 of 2015 the same stands rejected for non- prosecution. Consequently, the RPFAM stands dismissed.

5. Interim order dated 22nd April, 2015 passed in Misc. Case No.42 of 2015 stands vacated.

6. Office shall communicate the order to learned Judge, Family Court, Dhenkanal forthwith.
