05. 1. Mr. Rao, learned Senior Counsel for the Petitioner points out how the Petitioner is today 75 years old and the trial is going on interminably without any hope of conclusion. As of the date only eight out of the sixteen prosecution witnesses (PWs) have been examined so far.

2. The Court directs the Special Judge, Vigilance, Sundargarh to pass a case management order after consultation with counsel for both the parties, for which purpose the matter i.e. CTR No.01 of 2005 arising out of Sambalpur Vigilance P.S. Case No.65 of 2002 will be listed before the said Court on 10th April, 2023.

3. The entire case including pronouncement of judgment should be concluded positively on or before 3rd July, 2023. The Court makes it clear that considering the number of years the case has been pending, no further time beyond that fixed by the trial Court hereafter will be granted to any of the parties. The examination of the PWs and their cross-examination should be concluded

positively by 15th May, 2023. The case be given top priority as it is one of the very old cases of that Court.

4. A copy of this order shall be sent forthwith to the concerned Court. It is made clear that both parties should cooperate with the trial Court; not seek unnecessary adjournments and ensure that the above time schedule is adhered to.

5. The petition is disposed of with the above directions. A copy of this order shall be delivered forthwith by the Registry to the Special Judge, Vigilance, Sundargarh.
