        5.       1.       This matter is taken up through hybrid mode.

2. Judgment dated 27th September, 2016 (Annexure-1) passed by learned Judge, Family Court, Jajpur in Criminal Proceeding No.208 of 2011 is under challenge in this RPFAM, whereby the Petitioner has been directed to pay maintenance of Rs.3,000/- per month to the Opposite Party from the date of application, i.e., from 19th December, 2009.

3. Mr. Mohapatra, learned counsel for the Petitioner submits that he has no instruction with regard to the status of the parties at present. Thus, he is not in a position to argue the matter.

4. In view of the above, the RPFAM is dismissed for non- prosecution.

5. Interim order dated 5th December, 2016 passed in Misc. Case No.314 of 2016 stands vacated.
