3. 1. This matter is taken up through Hybrid mode.
2. Judgment dated 19th February, 2016 passed by learned Judge, Family Court, Phulbani in CRP No.28 of 2015 is under challenge in this RPFAM, whereby the application under Section 125 Cr.P.C. filed by the Petitioners has been rejected. There is also delay of one day in filing the RPFAM.
3. However, learned counsel for the Petitioner by filing a memo submits that he has no instruction in the matter.
4. In view of the memo filed, the IA filed for condonation of delay stands dismissed for non-prosecution and consequentially, the RPFAM also stands dismissed being barred by limitation. Memo so filed be kept on record.
