06. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. Ms. S. Das, learned counsel appearing on instruction of Mr. A.K. Panda, learned counsel for the applicant has submitted that the applicant would deposit 50% of the permanent alimony which has been determined by the Civil Judge, Senior Division, Talcher by the Judgment dated 18.04.2017, as condition-precedent for condoning the delay.
3. Ms. Das, learned counsel has submitted that the applicant has a good case on merit. Even though the delay of 1576 days is apparently inordinate, but for substantial ends of justice, the said delay deserves to be condoned.
4. Be that as it may, let the appeal be listed again on 20.04.2023. Meanwhile, the applicant shall deposit the said amount i.e. Rs.2.50 lakhs in the form of Demand Draft/Banker's Cheque, drawn in favour of the Opposite Party.
5. Mr. R.R. Das Nayak, learned counsel has appeared for the Opposite Party No.1.
