CORAM:
THE CHIEF JUSTICE
JUSTICE G. SATAPATHY
ORDER
Order No. 21.06.2023
03. 1. There is an extra ordinary delay of 630 days in preferring the petition seeking leave to appeal against the judgment dated 25th January, 2005 passed by the Additional Sessions Judge, Talcher in C.T. Case No. 4 of 2003 arising out of G.R. Case No. 299 of 2002 corresponding to Talcher P.S. Case No. 71 of 2002 acquitting the Respondents of the offences Under Section 302 read with Section 34 IPC. Having examined the application for condonation of delay, the Court finds the reasons adduced therein are wholly unsatisfactory and do not meet the requirements as explained by Supreme Court of India in Chief Post Master General v. Living Media India Ltd. (2012) 3 SCC 563 and The State of Madhya Pradesh v. Bherulal (2020) 10 SCC.
2. Consequently, the application of condonation of delay is dismissed. As a result, the criminal leave petition is dismissed.
