        13.      1.      This matter is taken up through hybrid mode.

2. This appeal has been filed assailing the judgment/order dated 2nd April, 2010 passed by learned District Judge, Koraput at Jeypore in Matrimonial Case No.1 of 2009, whereby refusing to grant a decree of divorce under Section 27 of the Special Marriage Act, 1954 (for short 'the Act') against the Opposite Party, learned District Judge passed a decree of judicial separation between the parties under Section 27 (1) (a) of the Act.

3. Mr. Nayak, learned counsel appearing on behalf of Mr. Behera, learned counsel for the Petitioner by filing a memo prays for withdrawal of the appeal.

4. Accordingly, the appeal is dismissed as withdrawn.
